The following steps and documents are provided to inform and assist prospective Marijuana Special Permit applicants in the Town of Medway and to ensure compliance with the Cannabis Control Commission's Municipal Equity recommendations in establishing fair, transparent, and equitable licensing processes for marijuana businesses at the local level. A Marijuana Special Permit is required for a proposed Registered Medical Marijuana Facility (RMMF) or Recreational Marijuana Establishment (RME).
Major Site Plan Review
A project will trigger Major Site Plan Review (ZBL 3.5.3) under the following cicumstances:
- New construction or any alteration, reconstruction, renovation, and/or change in use of
any multi-family, commercial, industrial, institutional, or municipal building or use
which involves one or more of the following:- i. the addition of 2,500 square feet or more of gross floor area; or
- ii. the addition of twenty or more new parking spaces
- The redesign, alteration, expansion or modification of an existing parking area involving
the addition of twenty or more new parking spaces. - The redesign of the layout or configuration of an existing parking area of forty or more
parking spaces - Construction of ground mounted solar photovoltaic installations of any size in any
zoning district including solar canopy type systems in parking areas - Removal, disturbance, and/or alteration of 20,000 square feet or more of existing
impervious surface. - Tier 2 Battery Energy Storage Systems
Minor Site Plan Review
A project will trigger Minor Site Plan Review (ZBL 3.5.3) under the following circumstances:
- New construction or any alteration, reconstruction, renovation, and/or change in use of
any multi-family, commercial, industrial, institutional, or municipal building use which
is not subject to Major Site Plan Review but which involves one or more of the
following:- i. the addition of 1,000 to 2,499 square feet of gross floor area; or
- ii. the addition of ten or more but less than twenty new parking spaces
- The redesign, alteration, expansion or modification of an existing parking area
involving the addition of ten or more but less than twenty new parking spaces - The redesign of the layout or configuration of an existing parking area of twenty to
thirty-nine parking spaces - Any use or structure or expansion thereof exempt under Massachusetts G.L. c. 40A,
§ 3. only to the extent allowed by law. - Removal, disturbance, and/or alteration of 10,000 to 19,999 square feet of impervious
surface. - Installation of a wireless communication facility as defined in Section 8.7 of this
Zoning Bylaw. - Installation of electric vehicle charging station(s) with digital advertising signage.
- Tier 1 Battery Energy Storage Systems
Land Disturbance Permit
A project will require a Land Disturbance Permit under the following circumstances:
- 20,000 square feet or more
- Review for removal, disturbance, alteration, or addition of 10,000 square feet or more of impervious surface
The Conservation Commission shall be the Permitting Authority for Land Disturbance permits, except that, if subdivision, site plan, or special permit approval from the Planning and Economic Development Board (PEDB), is required, and there are no activities subject to the Conservation Commission jurisdiction under the Wetland Protection Act or the Town’s Wetland Protection Bylaw, Land Disturbance Permits shall be reviewed and issued by the PEDB as a component of those other permits, including the fees, regulations, timing, notice and hearing requirements of those other permits.
Facade Improvement Review
If a project does not trigger Major or Minor Site Plan Review, but proposes any alterations, renovations, or reconstruction, the project will require a Facade Improvement Review application with the Design Review Committee under the following circumstances:
- installation or replacement of awnings
- change in a building’s exterior surface material
- rearrangement or addition of windows or doors
- façade reconstruction or replacement
Sign Design Review
A project will require a Sign Design Review application with the Design Review Committee if your proposed signage is greater than or equal six square feet in sign surface area.
